At Southern New Hampshire University (SNHU), we respect the intellectual property rights of others and are committed to complying with the Digital Millennium Copyright Act (DMCA). This policy outlines how we handle copyright infringement claims on our website, online portals, and services.

If you believe your copyrighted material has been used in a way that constitutes copyright infringement, please follow the process outlined below.

1. Filing a DMCA Notice

If you are the copyright owner or authorized to act on behalf of the copyright owner, you may send a written notice of infringement to our designated DMCA Agent. Your notice must include the following information, as required by the DMCA:

  1. Identification of the copyrighted work: Clearly describe the work you believe has been infringed. If multiple works are affected, you may submit a representative list.
  2. Identification of the infringing material: Provide the URL or specific location on our site where the infringing content can be found. Be as detailed as possible to help us locate the material.
  3. Your contact information: Include your full name, mailing address, telephone number, and email address so we can contact you if needed.
  4. A statement of good faith: Confirm that you believe, in good faith, that the use of the material is not authorized by the copyright owner, their agent, or the law.
  5. A statement of accuracy: Include a statement that the information provided in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
  6. Your physical or electronic signature: A valid signature is required to complete your notice.

3. Counter-Notification

If you believe that your material was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our DMCA Agent. Your counter-notification must include:

  1. Identification of the material: Describe the material that has been removed or disabled and where it appeared before it was removed.
  2. Your contact information: Provide your full name, address, telephone number, and email address.
  3. A statement under penalty of perjury: Declare, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of an error or misidentification.
  4. Consent to jurisdiction: Include a statement consenting to the jurisdiction of the federal court in your district or, if you are outside the United States, the district where SNHU is located.
  5. Your physical or electronic signature: A valid signature is required to complete your counter-notification.

Once a valid counter-notification is received, we may restore the material in question unless the original complainant files a legal action seeking a court order to prevent its restoration.

4. Repeat Infringers

SNHU reserves the right to terminate the accounts or access of users who are repeat infringers, in accordance with the DMCA and applicable laws.

5. False Claims

Submitting a false DMCA notice or counter-notification may result in legal consequences. We encourage all parties to act in good faith and ensure that their claims are accurate and lawful.
